Can I Opt Out of Kleinunternehmerregelung for Vorsteuer?

When Regelbesteuerung wins, the five-year bind, and how to declare the Verzicht cleanly.

Founder math question: My hardware and software invoices are full of USt. Should I waive Kleinunternehmer status?

When opting out is rational

IHK Stuttgart flags common cases:

  • Heavy startup investments with large Vorsteuer you want refunded
  • Mostly B2B clients who can reclaim USt, so net prices stay comparable
  • You already know you will smash the 25k / 100k rails soon anyway

If your clients are private end consumers who hate gross-up, Kleinunternehmer pricing can still win. Run both price sheets before you file a Verzicht.

The bind

A Verzicht zur Regelbesteuerung generally locks five calendar years. You cannot dip in and out when a single laptop purchase looks juicy. Plan the five-year window with a Steuerberater.

Mechanically, filing Voranmeldungen / a Regelbesteuerung declaration can itself be treated as Verzicht. Do not "test" a UStVA for fun.

How to declare

Explain the Verzicht to the Finanzamt within the statutory window (IHK example pattern: for year 2025, Verzicht explainer into February 2027). Prefer a clear written statement plus consistent filings. Keep the acknowledgment.

After opting out:

  • Update invoice templates to show USt
  • Register for Voranmeldungen
  • Track Dauerfristverlängerung if you want the buffer

Returning later

After five years, if Umsatz fits again, you may revoke the Verzicht prospectively for a future calendar year. That is another stamped letter, not a silent template change.
